The Government of India on Friday, July 5, notified another set of sections of the Telecommunications Act 2023, which came into effect immediately.
A key aspect covered in the latest notification is the federal government’s focus on increasing efficiency in spectrum utilization through various means such as secondary assignment, sharing, and trading, the Ministry of Communications stated.
The government issued a notification enforcing Sections 6-8, 48, and 59(b) of the Telecommunications Act 2023 with immediate effect. Salient features of the enforced sections include optimal utilization of the spectrum.
“The Act provides a legal framework for efficient utilization of scarce spectrum through processes such as secondary assignment, sharing, trading, leasing, and surrender of spectrum,” the ministry said.
It also enables the utilization of spectrum in a flexible, liberalized, and technologically neutral manner, while empowering the government to establish an enforcement and monitoring mechanism.
The Act immediately prohibits the use of any equipment that blocks telecommunication, unless permitted by the government.
The Telecommunications Act 2023 aims to amend and consolidate laws relating to the development, expansion, and operation of telecommunication services and networks; the assignment of spectrum; and related matters. “The Act also seeks to repeal existing legislative frameworks like the Indian Telegraph Act 1885 and Indian Wireless Telegraph Act 1933, owing to significant technological advancements in the telecom sector,” the ministry added.
